Acceptance of these terms
By visiting or using rallytakesthetrain.com (the "Site"), you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the Site. We may update these terms at any time by posting a revised version with a new "Last updated" date; continued use after a change means you accept it.
What the Site is
The Site is the official website for the children's picture book Rally Takes the Train, written by Kelsey Lizee Cecil and illustrated by Leslie Dunn. It exists to tell you about the book, show you a few pages, share the story behind it, and send you to Amazon if you'd like to buy it. The Site is operated by the author ("we," "us," "our").
Purchases and Amazon
The Site does not sell products directly, take payment, or ship books. Every "Buy on Amazon" link takes you to Amazon.com, where Amazon is the seller of record. Your purchase, payment, shipping, and any return or refund are governed entirely by Amazon's terms, policies, and return policy, not by these terms. Prices and availability shown on the Site are for information only and may differ from what Amazon displays at the time of purchase; Amazon's listing controls.
Some links to Amazon may be affiliate links. If so, we may earn a small commission on qualifying purchases at no additional cost to you.
Copyright and trademarks
Everything on the Site and in the book is protected by copyright and other intellectual property laws. Unless otherwise noted:

- The illustrations in the book and on the Site are © Leslie Dunn and are used with permission. All rights reserved.
- Photographs of the author and of Rally the corgi are © the author.
- Reader reviews quoted on the Site are the property of their respective authors and are reproduced from Amazon.
- Amazon, Prime, and related marks are trademarks of Amazon.com, Inc. or its affiliates. Other names and marks belong to their owners.
You may view, print, and share pages of the Site for personal, non-commercial purposes, and you may share links to the Site freely. You may not copy, reproduce, scan, distribute, create derivative works from, or commercially exploit any text, illustration, photo, or page of the book or the Site without our prior written permission. That includes using the illustrations or text to train, fine-tune, or prompt an artificial-intelligence model, and reproducing the book's pages in any format. Every illustration in the book was painted by hand; please respect the work that went into it.
Teachers, librarians, reviewers, bloggers, and press: we are usually happy to grant permission for excerpts, cover images, and a limited number of interior pages for reviews, read-alouds, classroom use, and features. Email kelseylcecil@gmail.com.
What you may and may not do
When using the Site, you agree not to:
- Use the Site in any way that violates applicable law or these terms.
- Scrape, crawl, or harvest content or data from the Site other than through standard search-engine indexing.
- Attempt to gain unauthorized access to the Site, its hosting, or related systems, or interfere with its operation.
- Introduce viruses, malware, or other harmful code.
- Impersonate us, the author, or the illustrator, or misrepresent your affiliation with the book.
- Use the Site's content to create a competing product or to pass off the book, its characters, or its artwork as your own.
Third-party links
The Site links to Amazon and may link to social media, other retailers, and other websites. We do not control those sites and are not responsible for their content, availability, policies, or practices. A link is not an endorsement. When you leave the Site, the other site's terms and privacy policy apply.
Disclaimers
The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses, or that information on it (including prices, ratings, and availability shown from Amazon) is accurate or current. Reading age ranges and descriptions are general guidance only; adults should use their own judgment about what is suitable for a particular child. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you.
Limitation of liability
To the fullest extent permitted by law, we, the author, the illustrator, and anyone who helps run the Site will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of or inability to use the Site, even if advised of the possibility of such damages. Our total liability for any claim relating to the Site will not exceed one hundred US dollars ($100). Nothing in these terms limits liability that cannot be limited under applicable law.
Indemnification
You agree to defend, indemnify, and hold harmless us, the author, and the illustrator from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these terms or your misuse of the Site or its content.
Governing law and disputes
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute relating to the Site that cannot be resolved informally will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction. Before filing any claim, you agree to contact us at kelseylcecil@gmail.com and make a good-faith attempt to resolve the matter for at least 30 days.
General terms
- Entire agreement. These terms and the Privacy Policy are the entire agreement between you and us about the Site.
- Severability. If any part of these terms is found unenforceable, the rest remains in effect.
- No waiver. Our not enforcing a provision is not a waiver of our right to enforce it later.
- Assignment. We may assign these terms, for example if the book or Site changes hands. You may not assign them.
- Copyright complaints. If you believe content on the Site infringes your copyright, email kelseylcecil@gmail.com with the work, the location on the Site, your contact details, and a statement of good-faith belief, and we will respond promptly.
